Nel febbraio 2009, l’attivista e filosofo Daniel Bensaïd si è chiesto – sulla base di Marx – se la salute potesse avere un prezzo, così come la conoscenza, e se ci fosse un diritto incondizionato alla casa, all’istruzione, ecc. Ha quindi posto una serie di domande fondamentali sul processo di privatizzazione del mondo in corso, in altre parole sulla distruzione neoliberale dei servizi pubblici e la logica del comune che essi portano; una distruzione le cui drammatiche conseguenze si possono vedere al tempo di Covid-19.
Riducendo il valore di mercato di qualsiasi ricchezza, di qualsiasi prodotto, di qualsiasi servizio, al tempo di lavoro socialmente necessario per la sua produzione, la legge del mercato mira a rendere commensurabile l’incommensurabile, ad attribuire un prezzo monetario a ciò che è difficile da quantificare. Come equivalente generale, il denaro ha quindi il potere di trasformare tutto. Come agente di una traduzione universale, “confonde e scambia tutto, è il mondo al contrario, la conversione e la confusione di tutte le qualità generali e umane “ (dai “Manoscritti” di Marx, 1844). La mercificazione generalizzata mira effettivamente a dare un prezzo a ciò che non ne ha:
Questo sforzo di dare un prezzo a tutto ciò che può essere scambiato è aumentato considerevolmente”, nota Marcel Hénaff. Siamo scivolati verso un concetto di mercificazione illimitata: tutto può essere valutato su un mercato, quindi tutto può essere venduto, comprese le merci invendibili ” (Marcel Hénaff, « Comment interpréter le don », in Esprit, febbraio 2002. Marcel Hénaff è l’autore di Le Prix de la vérité. Le don, l’argent, la philosophie, Paris, Seuil, 2002).
Il servizio pubblico può o deve essere gratuito, ma l’insegnante o l’infermiere deve nutrirsi e vestirsi. Una domanda di attualità è: qual è lo stipendio di un insegnante-ricercatore universitario? Non vende un prodotto (una merce-sapere), ma riceve una remunerazione finanziata dalla perequazione fiscale per il tempo di lavoro socialmente necessario alla produzione e riproduzione della sua forza lavoro (compreso il tempo di formazione). È solo il tempo passato nel suo laboratorio o il tempo passato davanti allo schermo del suo computer (cronometrato da un orologio incorporato)? Smette di pensare quando prende la metropolitana o fa jogging? Queste questioni sono tanto più spinose in quanto la produzione di conoscenza è altamente socializzata, difficile da individualizzare e comporta una grande quantità di lavoro morto. Tuttavia, le attuali riforme tendono a trasformare il nostro insegnante-ricercatore in un venditore di servizi commerciali. D’ora in poi, si suppone che vendano idee o conoscenze il cui valore di mercato dovrebbe essere misurato da procedure di valutazione (come la bibliometria quantitativa). Tuttavia, “non esiste una misura comune tra il denaro e la conoscenza”, come diceva saggiamente Aristotele.
La crisi attuale è una crisi storica – economica, sociale, ecologica – della legge del valore. La misurazione di tutto in base al tempo di lavoro astratto è diventata, come Marx aveva previsto nei suoi Manoscritti del 1857, una misura “miserabile” delle relazioni sociali. Ma “non si può gestire ciò che non si può misurare”, dice Pavan Sukhdev, ex direttore della Deutsche Bank di Bombay, che è stato incaricato dalla Commissione dell’Unione Europea di produrre un rapporto per “fornire una bussola ai leader di questo mondo” attribuendo “molto rapidamente un valore economico ai servizi resi dalla natura”! Misurare tutta la ricchezza materiale, sociale e culturale con il solo metro del tempo di lavoro socialmente necessario per la sua produzione sta però diventando sempre più problematico a causa della crescente socializzazione del lavoro e della massiccia incorporazione del lavoro intellettuale in questo lavoro socializzato.
Il lungo tempo dell’ecologia non è sicuramente il breve tempo dei prezzi di borsa! Attribuire un “valore economico” (monetario) ai servizi della natura si scontra con lo spinoso problema di stabilire un denominatore comune per le risorse naturali, per i servizi alle persone, per i beni materiali, per la qualità dell’aria, per l’acqua potabile, ecc. C’è bisogno di uno standard diverso dall’orario di lavoro e di uno strumento di misura diverso dal mercato, capace di valutare la qualità e le controparti a lungo termine dei guadagni immediati. Solo una democrazia sociale sarebbe capace di far corrispondere le risorse ai bisogni, di tener conto della lunga e lenta temporalità dei cicli naturali e di fissare i termini delle scelte sociali che integrano la loro dimensione ecologica.
Il demarketing delle relazioni sociali non può quindi essere ridotto a una semplice opposizione tra iò che è a pagamento e ciò che è gratuito. Immerso in un’economia di mercato competitiva, il libero accesso può anche essere perverso e servire come una macchina da guerra contro la produzione di qualità a pagamento. Questo è illustrato dalla proliferazione di giornali gratuiti a scapito del costoso lavoro di informazione e di indagine.
È certamente possibile immaginare e sperimentare aree di scambio diretto – non monetario – di beni o servizi personalizzati. Ma questo “paradigma del dono”, come procedura di riconoscimento reciproco, non può essere generalizzato, a meno che non si concepisca un ritorno a un’economia di baratto autarchica. Tuttavia, qualsiasi società di scambio esteso e di complessa divisione sociale del lavoro richiede una contabilità e una modalità di ridistribuzione della ricchezza prodotta.
La questione centrale della demercificazione è dunque quella delle forme di appropriazione e dei rapporti di proprietà, di cui il libero accesso (ai servizi pubblici o ai beni comuni) è solo un aspetto. È la privatizzazione generalizzata del mondo – cioè non solo dei prodotti e dei servizi, ma anche della conoscenza, della vita, dello spazio e della violenza – che rende tutto una merce vendibile. Stiamo quindi assistendo, su scala molto più ampia, a un fenomeno paragonabile a quello che è avvenuto all’inizio del XIX secolo con un’offensiva su larga scala contro i diritti consuetudinari dei poveri: privatizzazione e mercificazione dei beni comuni e distruzione metodica delle solidarietà tradizionali (famiglia e villaggio in passato, sistemi di protezione sociale oggi) (Daniel Bensaïd, Les Dépossédés. Karl Marx, les voleurs de bois et le droit des pauvres, Paris, La Fabrique, 2006).
Le controversie sulla proprietà intellettuale sono esemplari in questo senso:
“La minima idea suscettibile di generare un’attività è messa a prezzo, come nel mondo dello spettacolo dove non c’è un’intuizione, non un progetto che non sia immediatamente coperto da un copyright. Una corsa all’appropriazione, al profitto. Non condividiamo: catturiamo, ci appropriamo, traffichiamo. Può arrivare il momento in cui sarà impossibile fare qualsiasi dichiarazione senza scoprire che è stata debitamente protetta e soggetta a diritti di proprietà (Marcel Hénaff, “Comment interpréter le don”).
Con l’adozione nel 1994 dell’accordo Trips (Trade Related Aspects of Intellectual Property Rights) come parte degli accordi dell’Uruguay Round (da cui è nata l’Organizzazione Mondiale del Commercio), i governi dei maggiori paesi industrializzati sono riusciti a imporre il rispetto globale dei brevetti. In precedenza, non solo la loro validità non era riconosciuta a livello mondiale, ma cinquanta paesi escludevano del tutto il brevetto di una sostanza e riconoscevano solo i brevetti sui processi di fabbricazione.
Dagli anni ’70, abbiamo così assistito a un’assolutizzazione dei diritti di piena proprietà, una formidabile appropriazione privata da parte delle multinazionali del sapere e della produzione intellettuale e artistica in generale. Di fronte alla possibilità di mettere il software a disposizione degli utenti, il prestito gratuito delle biblioteche è stato messo in discussione alla fine degli anni ’80. Da allora, poiché l’informazione è diventata una nuova forma di capitale, il numero di brevetti depositati ogni anno è esploso (156.000 nel 2007). Monsanto, Bayer e Basf da sole hanno depositato 532 brevetti su geni resistenti alla siccità. I cosiddetti “troll” stanno acquistando portafogli di brevetti per citare in giudizio per violazione i produttori il cui business utilizza un corpo di conoscenze inestricabilmente legato. Questa corsa al brevetto è una nuova forma di recinzione contro il libero accesso alla conoscenza, e genera una vera e propria “bolla dei brevetti”.
Questa estensione del diritto dei brevetti autorizza la brevettazione di varietà di piante coltivate o di animali da allevamento, e poi di sostanze di un essere vivente, confondendo la distinzione tra invenzione e scoperta, e aprendo la strada al saccheggio neo-imperialista attraverso l’appropriazione delle conoscenze zoologiche o botaniche tradizionali. Ciò che è grave non è tanto il fatto che la brevettazione delle sequenze di DNA costituirebbe un attacco alla divina Creazione, ma che l’elucidazione di un fenomeno naturale potrebbe d’ora in poi essere oggetto di un diritto di proprietà. La descrizione di una sequenza genetica è una conoscenza, non un fatto. I brevetti e i diritti d’autore erano originariamente basati sull’obbligo di divulgare pubblicamente la conoscenza in questione. Questa regola è stata aggirata molte volte (in particolare in nome del segreto militare), ma Lavoisier non ha brevettato l’ossigeno, Einstein la teoria della relatività o Watson e Crick la doppia elica del DNA. Mentre la piena divulgazione ha favorito le rivoluzioni scientifiche e tecniche a partire dal XVII secolo, la porzione di risultati messi in pubblico dominio sta ora diminuendo, mentre la porzione confiscata dal brevetto per essere venduta o per generare reddito sta aumentando.
Nel 2008, Microsoft ha annunciato che rendeva i dati del suo software di punta liberamente disponibili su Internet e ne autorizzava l’uso gratuito per sviluppi non commerciali. In un’intervista a Médiapart, il direttore degli affari legali, Marc Mossé, ha subito precisato che non si tratta di una sfida alla proprietà intellettuale, ma semplicemente di una “dimostrazione che la proprietà intellettuale può essere dinamica”. Di fronte alla concorrenza del software libero, il software commerciale come Microsoft è stato costretto ad adattarsi parzialmente a questa logica del libero accesso, alla cui base c’è la crescente contraddizione tra l’appropriazione privata dei beni comuni e la socializzazione del lavoro intellettuale che inizia con la pratica del linguaggio.
A suo tempo, l’accaparramento privato delle terre fu difeso in nome della produttività agraria, il cui aumento avrebbe dovuto sradicare la fame e la carestia. Oggi assistiamo a una nuova ondata di recinzioni, giustificata a sua volta dalla corsa all’innovazione e dall’emergenza alimentare globale. Ma l’uso della terra è “mutuamente esclusivo” (ciò che uno si appropria, l’altro non può usarlo), mentre l’uso della conoscenza è ineguagliabile: il bene non si estingue nell’uso che se ne fa, che sia una sequenza genetica o un’immagine digitale. Ecco perché, dal monaco copista alla posta elettronica, passando per la stampa o la fotocopiatura, il costo della riproduzione ha continuato a scendere. Ed è per questo che la giustificazione dell’appropriazione privata oggi è la stimolazione della ricerca piuttosto che l’uso del prodotto.
Rallentando la diffusione dell’innovazione e il suo arricchimento, la privatizzazione contraddice le affermazioni del discorso liberale sui suoi benefici competitivi. Al contrario, il principio del software libero registra a suo modo il carattere fortemente cooperativo del lavoro sociale che si cristallizza in esso. Il monopolio del proprietario non è più contestato, come per i liberali, in nome della virtù innovativa della concorrenza, ma come un ostacolo alla libera cooperazione. L’ambivalenza del termine inglese free applicato al software fa quindi rima con freedom.
Come all’epoca delle recinzioni, gli espropriatori di oggi pretendono di proteggere le risorse naturali e promuovere l’innovazione. Si può dire loro quello che diceva la Carta dei contadini tedeschi insorti nel 1525:
“I nostri signori si sono appropriati dei boschi, e se il povero ha bisogno di qualcosa, deve comprarlo al doppio del prezzo. La nostra opinione è che tutti i boschi dovrebbero tornare di proprietà di tutto il comune, e che dovrebbe essere più o meno libero per chiunque nel comune di prendere legna da esso senza pagarla. Deve solo istruire una commissione eletta a questo scopo dal comune. Questo eviterà lo sfruttamento”.
